ahead of john brennan's confirmation hearing to head the cia, the obama administration's drone program is drawing new scrutiny from both sides of the aisle and raising big questions about just how far the government should go in targeted assassinations without oversight from congress or from the courts. joining me now for our daily fix, msnbc contributor and "usa today" washington bureau chief. chris, first to you, i don't think there is any big question so far as to whether or not john brennan is going to be confirmed at least going into the hearing, but this is a real debate now. because of michael isikoff breaking the story and finding that white paper, and discovering that the justice department had at least september that much to the hill, some members, the 11 senators and at least three the committee asking big questions about why there isn't more oversight. >> what's fascinating is when they announced the trio of nominations, john kerry at state, chuck hagel at defense and john brennan for cia, i remember being on the show and saying i think hagel will be the most controversial
a lawless president icy with this drone program obama has gone lightyears beyond what the bush administration did. and by the way, if bush ever attempted this narrative, these policies, i'm telling you democrats would have been calling for are bush's impeachment. it is important to remind the american people exactly what the bush administration did in terms of terrorists. they endorsed enhanced interrogation techniques including waterboarding on exactly three, that's it, three high value terrorist detainees. one being khalid shaikh muhammad who was the mastermind of 9/11. no terrorist was ever water boarded and killed and on the contrary the obama administration is a allowing the targeting of american citizens to die. killing them without allowing them any legal recourse, no safeguards in place and the killings themselves are based on limits that one aclu official likely called elastic, vaguely defined and easily manipulated and d in the pro process killing many other nontargetted human beings in one case innocent children. i have to ask are the democrats going to rake obama ov

precision strikes against al qaeda and their aaffiliates. >> that was president obama last month defending the drone program. in his four years in office, the president has made unprecedented use of this weapon, with more than 400 cia strikes against targets in pakistan and yemen. that's eight times as many as under president george w. bush. and now nbc news's michael isikoff has obtained a 16-page justice department memo that makes the legal argument to justify this administration's use of drones to kill terror suspects, including american citizens. the government can order the killing of its own citizens without due process if those citizens are believed to be senior operational leaders of al qaeda or an associated force, even if there is no intel indicating they are involved in an active plot to attack the united states. today attorney general eric holder addressed the issue. >> we only take these kinds of actions when there is an eminent threat, when capture is not feasible, and when we are confident we are doing so in a way that is consistent with federal and international law. >> yet

obama, john brennan is first going to have to face questions on thursday about some of what michael isikoff turned up here on this program last night. a justice department white paper elaborating the administration's reasoning for why it thinks it is legal to kill american citizens on the president's say so. or actually, on the say so of an informed high level official of the u.s. government. so maybe that's the president, but maybe that's somebody else. michael isikoff's scoop ended up at "the new york times" today and "the washington post" and "the hill" and slate and salon and ap to name a few. it was everywhere. and then at a press conference today, the attorney general was asked about it. >> last night nbc reported a white paper that was prepared by the justice department undated, unsigned about the legal -- the legal pinnacles for targeting americans overseas. could you please give us what the precise definition is and how that would be carried out? >> well, there have been a series of speeches that i gave, jay johnson gave, john brennan gave where we try to lay out for the am
as compromisers as sellouts, all of the things you heard clinton called and obama called and you will hear every future democratic president called that too. that's just the nature of our system. >> jennifer: it is. it is. so where does the drone program fit into this new liberalism. do you think this released memo. this drone program that needs some contours, everybody agrees but is it going to hurt the president? >> i think it will marginally hurt him among liberals. it is pretty mild compared to the what the civil liberties left have had for the americans. the vietnam war is one embarrassing example of what bob dole called a democrat war. this is certainly a problem. the drone strikes, and i share a lot of the nervousness and -- about these drone strikes. there is an argument -- there are arguments on -- on the pro-drone strike side as well as the anti-drone side. but, yes, it is going to be a problem. a bigger problem would be if the president were to make too generous to the right a deal on social insurance -- cuts in snowstorm insurance programs. >> jennifer: i agre
for a senate confirmation hearing to potentially become the next director of the c.i.a. he was president obama's number one counterterrorism advisor oz the drone program grew and he'll likely get lot of questions about this secret memo. so yesterday the white house explained how drone strikes against american citizens can help protect the homeland. >> we have acknowledged, the united states, that sometimes we use remotley piloted aircraft to conduct targeted strikes against specific al-qaeda terrorists in order to prevent attacks on the united states and to save american lives. we conduct those strikes because they are necessary to mitigate ongoing actual threats, to stop plots, prevent future attacks and save american lives. the strikes are legal. they are ethical and they are wise. >> the only time president obama has ordered a strike against an american citizen that we know about was back in 2011 when anwar al-awlaki and kahn were killed in yemen. >> brian: his son was killed, too. >> steve: 16-year-old born in colorado, they are suing the federal government. they say it's unconstitutional.
to do about a u.s. citizen that the government wants to target overseas. host: when did this program began? guest: i think around 2002. it began under the bush administration but really got very little attention. it really ramped up under president obama as a favorite option of this administration. kind of low profile in terms of boots on the ground. the bush administration came in at a time when the country was really weary of two wars in iraq and afghanistan. the use of drones seemed to present a very attractive solution because very few military personnel could be involved, it can be operated in an over the horizon fashion where you don't have to even be based in the country where the action is going to be carried out. and supporters of the program say that the drones are actually fairly precise compared to other types of military operations. there's a lot of discussion on try to capture people instead of using drones. you can have a civilian casualties in and on the ground type of military operation. some experts will say they are perhaps even more likely using larger type of wea
